1. Acceptance of Terms
By accessing or using the TickerGainer platform (“Service”) provided by TickerGainer Technologies Pvt. Ltd. (“Company”, “we”, “us”), you (“User”, “you”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Service.
These Terms apply to all users including visitors, registered users, and administrators.
2. Eligibility
To use TickerGainer, you must:
- Be at least 18 years of age (or the age of majority in your jurisdiction)
- Have the legal capacity to enter into binding agreements
- Not be prohibited from using financial tools or trading platforms under the laws of your jurisdiction
- Maintain a valid brokerage account with a supported broker and comply with that broker’s own terms of service
By using the Service, you represent and warrant that you meet these requirements.
3. Description of Service
TickerGainer is an automated trading workflow platform that:
- Discovers and qualifies stock tickers based on configurable algorithmic criteria (price momentum, news sentiment, volume, technical indicators)
- Sends alert emails to registered users with qualified ticker lists
- Optionally executes buy and sell orders on your behalf via broker APIs when auto-trading is enabled in your settings
- Monitors open positions and applies configurable exit strategies (stop-loss, take-profit, time-based exits)
- Provides a dashboard for reviewing trade history, positions, and signal analytics
The Service is provided “as-is” and may be updated, modified, or discontinued at any time.
4. No Financial Advice
TickerGainer is a technology tool, NOT a registered investment adviser, broker-dealer, or financial planner. Nothing on this platform constitutes financial, investment, legal, or tax advice.
All trading signals, qualified ticker lists, scores, alerts, and analytics provided by the platform are algorithmic outputs generated from publicly available market data. They are provided for informational and educational purposes only.
- Past performance of any signal, ticker, or strategy is not indicative of future results.
- All investments involve risk, including the possible loss of principal.
- You are solely responsible for your own trading decisions.
- You should consult a qualified financial adviser before making any investment decisions.
5. Accounts & Security
- You are responsible for maintaining the confidentiality of your login credentials.
- You must notify us immediately at support@tickergainer.com if you suspect unauthorised access to your account.
- You are responsible for all activities that occur under your account.
- One email address may be used for only one account. Creating multiple accounts to circumvent restrictions is prohibited.
- We reserve the right to suspend accounts showing signs of abuse or unauthorised access.
6. Acceptable Use
You agree not to:
- Use the platform for illegal trading activity including market manipulation, wash trading, or insider trading
- Attempt to reverse-engineer, scrape, or extract proprietary algorithms or data from the platform
- Share account credentials with third parties
- Introduce malware, bots, or automated scripts that interact with the platform outside of its intended API
- Use the platform in any way that could overload, damage, or impair its infrastructure
- Misrepresent your identity or affiliation
Violation of these rules may result in immediate account suspension and, where applicable, reporting to relevant authorities.
7. Broker Credentials & Trade Execution
When you provide broker API keys to the platform:
- Your credentials are encrypted and stored securely. They are used solely to execute trade instructions on your behalf as configured in your settings.
- You authorise TickerGainer to place orders with your broker on your behalf when auto-trading is enabled.
- You are solely responsible for the configuration of your auto-trading settings (position sizing, risk limits, allowed tickers, stop-loss levels).
- We are not liable for any financial losses arising from trade execution, including losses due to slippage, API errors, broker downtime, or algorithm output.
- You may revoke API access at any time by disabling auto-trading in settings or revoking the API key at your broker.
You should only grant API keys with the minimum permissions needed (trading permissions). We strongly recommend not granting withdrawal permissions to any API key stored on this platform.
8. Fees & Subscriptions
Details of any applicable subscription tiers, fees, and billing terms are presented at the time of sign-up or upgrade. By subscribing:
- You authorise us to charge your payment method on the stated billing cycle.
- All fees are non-refundable except where required by law.
- We reserve the right to change pricing with at least 14 days’ notice via email.
- Free-tier features may be modified or discontinued at any time.
If no fee schedule is presented, the Service is provided free of charge subject to these Terms.
Service Fee on Profitable Trades (1%) — Applies Regardless of Where the Sell Occurs
TickerGainer charges a
1% service fee on the dollar profit of any trade
that was initiated through the platform (i.e. the buy order was placed or facilitated by
TickerGainer),
regardless of where the sell order is executed.
External Sell Detection: Our position reconciliation system continuously monitors
your broker account. If we detect that a position tracked by TickerGainer has been
closed outside the platform (e.g. you sold directly in your Alpaca or Robinhood app), we will:
- Retrieve the fill price from your broker’s order history via the same API credentials you have provided
- Calculate the profit on the trade
- Record a 1% service fee against your account
- Send you an email notification with the trade summary
- Automatically cancel any orphaned take-profit or stop-loss orders
- Remove the position from your active trades
Fee amounts are logged in your account’s fee history and are viewable in your dashboard.
By continuing to use the platform and connecting broker API credentials, you expressly consent
to this monitoring and the associated fee capture process.
9. Intellectual Property
All content, algorithms, design, source code, trademarks, and branding associated with TickerGainer are the exclusive property of TickerGainer Technologies Pvt. Ltd. or its licensors.
You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for your personal trading purposes. You may not copy, reproduce, distribute, or create derivative works without express written permission.
User-provided data (your trade history, configuration) remains your property. You grant us a licence to process and store it solely to provide the Service.
10. Disclaimers & Limitation of Liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- TickerGainer IS NOT LIABLE FOR ANY TRADING LOSSES, MISSED OPPORTUNITIES, OR FINANCIAL DAMAGES ARISING FROM USE OF THE PLATFORM.
- OUR TOTAL LIABILITY IN ANY CIRCUMSTANCE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM.
- WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
- WE DO NOT GUARANTEE UPTIME, DATA ACCURACY, OR UNINTERRUPTED SERVICE.
11. Indemnification
You agree to indemnify, defend, and hold harmless TickerGainer Technologies Pvt. Ltd., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your trading activity or investment decisions
- Your violation of any applicable law or the rights of any third party
12. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason including violation of these Terms.
You may close your account at any time by contacting support@tickergainer.com. Upon termination, your right to use the Service immediately ceases. Provisions of these Terms that by their nature should survive termination shall survive.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which TickerGainer Technologies Pvt. Ltd. is incorporated, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts of that jurisdiction.
If you are located in the European Union, nothing in these Terms limits your rights under applicable EU consumer protection laws.
14. Changes to These Terms
We reserve the right to update these Terms at any time. When we do, we will revise the “Last updated” date at the top of this page and, where the changes are material, notify you via the email address on your account. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
